Ministry Of Labour Hours Of Work Agreement

The standard working time is eight hours a day and 40 hours a week. A week is from Sunday to Saturday. You can agree that your overtime should be “average”. This means that you will receive overtime with the average number of overtime hours you work for a period of 2 weeks or more up to a maximum of 4 weeks, and not with the actual number of overtime hours you work per week. You can use the Ministry of Labor`s Averaging & Time Off in Lieu Calculator to see how much overtime you would get over 2, 3 or 4 weeks if you have an average deal. As a general rule, a worker may not work more than eight hours per day (or the number of hours of his or her regular work day if it is longer), if he or she has given his or her consent electronically or in writing and the document entitled “Information for Employees on Working Time and Overtime Compensation” published by the Director of Employment Standards before the agreement is reached. Note that an electronic or written agreement must meet certain minimum requirements to be valid. There are exceptional circumstances in which a worker may be required to work or to work during a necessary rest period below the daily or weekly working time limits. The journey between the meeting place and the construction site is a paid travel time.

A divided stratum divides a working day into separate work periods. The employee`s workday is the sum of the hours worked during all periods. But an employer may ask you to sign an agreement that contains rules that are different from the normal rules in the ESA.
